Strict requirements for the form and content of claims are imperatively established by the norms of the Arbitrazh Procedure Code (APC RF). Any deviation from these rules at the stage of filing a claim creates a serious risk of the application being returned.

The claim must contain impeccably precise information about all participants in the process: the full name of the plaintiff and defendant (including an indication of individual entrepreneur status, if applicable), their exact legal addresses, as well as comprehensive identification data (TIN and OGRN). This information is fundamental for correctly determining the territorial arbitration court and for proper notification of the parties.

The next step is a clear and unambiguous designation of the subject of the claim. The demand made to the defendant must be as specific as possible: for example, a demand for recovery of the principal debt amount, a demand for recognition of ownership, or a demand for contract termination. Vague formulations conceal the risk of their rejection.

No less important is a detailed and reasoned statement of the grounds for the claim. This requires a description of the entire set of factual circumstances that led to the conflict, but, more importantly, a legal justification for these circumstances. The grounds for the claim must be supported by direct references to specific articles of civil legislation (for example, norms of the Civil Code of the Russian Federation) and the terms of the concluded contract that were violated by the defendant. Legal argumentation requires absolute logical consistency, linking each fact of violation to the relevant legal norm providing protection.

Special attention must be paid to the precise calculation of the amount of the claims. If a monetary claim is filed, it is subject to mandatory itemization by components: the amount of the principal debt, the amount of accrued contractual or statutory interest, and penalties (forfeiture, late fees). Every figure included in the calculation must be transparent, methodically substantiated, and supported by copies of primary accounting and financial documents. A calculation that cannot be verified by the attached materials will be rejected by the court, which will inevitably lead to delays in procedural deadlines.

From written correspondence to state duty

For a statement of claim submitted to an arbitration court to possess real persuasive power, it must be literally fortified by irrefutable evidence. An arbitration court,in its work, is guided by the principle of adversarial procedure and considers only the evidence officially presented by the parties. Weakness in the evidentiary base makes even the most just claim vulnerable.

Key procedural attachments, the submission of which is mandatory:

Copies of supporting documents: It is required to attach certified copies of all agreements, contracts, appendices, and specifications that form the subject of the dispute. These also include acceptance certificates, waybills, reconciliation acts, payment orders, and, importantly, official business correspondence proving the fact of violation and prior attempts at pre-trial settlement.

Proof of compliance with the claim procedure: The claim must be accompanied by documents confirming the sending of the claim to the defendant.

Confirmation of sending the claim to the defendant: The APC RF mandates that a copy of the claim and all its attachments must be sent to all participants in the process before filing with the court. Documentary proof of this step is a receipt and an inventory of contents from the post office. The absence of such proof is a direct ground for leaving the application without movement.

Document confirming payment of state duty: The amount of the duty is calculated based on the value of the claim. Without payment confirmation, the application will not be accepted.

Power of attorney for the representative: When filing a claim by an authorized representative, the corresponding power of attorney must be attached.

The correct preparation of the statement of claim, supported by precise calculation and a complete set of evidence, is the first and decisive stage of a successful arbitration process.
